1. Introduction
Welcome to CrestStoneLumen ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at creststonelumen.sbs (the "Service") operated by CrestStoneLumen.
By reserving a yacht or using our Service, you consent to adhere to these Terms. If you do not accept any part of these terms, you are prohibited from using the Service.
2. Service Overview
CrestStoneLumen offers high-end yacht charter services, which include, among others:
- Private daily yacht charters
- Evening boat tours
- Business getaways
- Exclusive events
- Extended excursions on the yacht
All services are subject to be available and dependent on weather conditions. We retain the right to alter or terminate services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To confirm a charter reservation, you must:
- Have reached the age of majority, at least 18 years old
- Supply accurate and comprehensive information
- Submit the necessary deposit as stated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A reservation is considered secure only after we receive the payment and send a written confirmation to you. We maintain the right to decline service to any individual at our own discretion.
3.3 Availability
All yacht bookings depend on the vessel being available and weather conditions being favorable. We pledge to make a reasonable effort to cater to your requested dates and times.
4. Payment Terms
4.1 Pricing
All listed prices are presented in £ and encompass applicable taxes unless specified otherwise. Prices may be amended without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the total cost of the charter is due at the time of reservation
- Remaining Balance: To be paid 48 hours before the commencement of the charter
- Extra fees (if applicable): To be settled upon the charter's conclusion
4.3 Payment Methods
We accept most major credit cards, electronic bank transfers, and certified checks. All payments are processed using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours prior to departure: A full refund minus transaction fees
- If cancelled between 24 to 72 hours prior to departure: A refund of 50% of the amount
- If cancelled less than 24 hours prior to departure: No refund is provided
5.2 Weather Cancellations
In the event that our captain deems the weather to be unsafe, we will propose to:
- Reschedule the charter to an alternative date at no added cost
- Issue a complete refund if rescheduling cannot be accommodated
5.3 Mechanical Issues
If encountered with mechanical issues with the assigned vessel, we will endeavor to find a suitable replacement. Should no alternative be available, a total refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all instructions given by the crew
- Use the safety equipment provided when necessary
- Inform about any medical conditions that might impact their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
The following items are banned from the yacht:
- Glass containers
- Illegal substances
- Firearms or any form of weapons
- Heavy amounts of beverages (surpassing what is considered moderate consumption)
- Animals (unless granted prior permission)
6.3 Conduct
Passengers must act respectfully at all times. Should behavior pose a threat to safety or disrupt the experience for others, we reserve the right to conclude the charter prematurely without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
We hold liability only up to the amount paid for your charter. We are not liable for:
- Personal injuries attributed to the negligence of the passengers
- Theft or harm to personal belongings
- Indirect, subsequent, or punitive losses
- Delays as a result of weather or situations beyond our command
7.2 Insurance Coverage
Comprehensive marine insurance is carried by us, which covers our ships and operations. Transport and personal insurance is the passenger's responsibility.
7.3 Assumption of Risk
By partaking in our charter services, you recognize nautical activities carry inherent dangers, and you accept accountability for your own safety and health.
8. Modifications and Itinerary Changes
The rights to adjust itineraries, routes, or schedules are reserved by us in light of weather conditions, safety concerns, or operational demands. We will make extensive efforts to offer equivalent alternatives when necessary.
9. Force Majeure
Delays, cancellations, or modifications resulting from factors outside of our control, such as severe weather, natural disasters, government enactments, harbors terminations, and mechanical failures, do not fall under our liability.
10. Privacy and Data Protection
Confidential information is managed as per our Privacy Policy. With the use of our services, you agree to the collection and utilization of your data as outlined in the Privacy Policy.
11. Intellectual Property
All material on our website, including but not limited to text, visuals, logos, and images, is safeguarded by copyright and trademark law. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
The applicable laws of United Kingdom govern these Terms. Any disputes will be adjudicated in the courts situated in Portsmouth, United Kingdom.
13. Changes to Terms
